Factory License in West Bengal

Planning to start a manufacturing unit in West Bengal?

Factory License in West Bengal:

Starting a manufacturing unit in West Bengal? Start by getting a factory license. It's one of the legally-required factory clearances. It confirms your registration with the Directorate of Factories and that your unit complies with norms for safety, health, labor and workplace standards.

In West Bengal, the licensing of factories is governed by the Factories Act, 1948 and the West Bengal Factories Rules, 1958. Applications for a factory license are made online through the Silpa Sathi portal under the Directorate of Factories in West Bengal.

In addition to a legal requirement, a factory license in West Bengal establishes your business, lowers your risk of exposure to legal penalties, and facilitates other necessary clearances related to industrial operations, including pollution, fire safety, trade and labor clearances.

Factorylicense.in assists manufacturers, occupiers, business owners, and industrial units in West Bengal in obtaining factory licenses through access to appropriate documentation, application submission, payment instructions, and renewal along with follow-up services.

Who Needs to be compulsorily registered?

In West Bengal, a factory license is required when your premises fall under the definition of a “factory” under the Factories Act, 1948.

West Bengal Registration Criteria

  • A premises is generally treated as a factory when 10 or more workers are working with the aid of power,
  • or 20 or more workers are working without the aid of power, and a manufacturing process is being carried on there.

  • Printing and packaging factories
  • Electrical and electronics assembly units

Manufacturing can involve making; processing; packing; repairing; and finishing, assembling, treating, or printing articles or materials. It can also involve cleaning or preparing articles or materials for use, sale, transportation, delivery, or disposal.

The factory's occupier is responsible for applying for the license. It could also be the owner, partner, director, an authorized signatory, or a person who exercises ultimate control over the factory’s operations.

West Bengal also has specific provisions for certain notified processes under Section 85 of the Factories Act, where factory-related provisions may apply even if the usual worker threshold is not met. The Directorate’s fee page mentions Section 85 registration and licensing fees separately.

Penalties for Non-Compliance of Factory License Rules

Factories operating in India that fail to fulfill their compliance obligations, including registration, licensing, and license renewal, face multiple severe risks. Pursuant to Section 92 of the Factories Act and the West Bengal Factory Rules, the occupier and manager of a non-compliant factory may be sentenced to a maximum of 2 years’ imprisonment, a fine of 100,000 rupees, or both. For any violations that continue after a conviction, an additional fine of up to 1,000 rupees will be imposed for each day the violation persists.

For overdue license renewals, a 25% surcharge on the standard fee applies if the renewal is filed within 3 months of the deadline, while a 50% surcharge applies if the delay exceeds 3 months.

In addition, non-compliant factories encounter a host of practical operational problems, including inspection objections, business interruptions, blocked approval processes, audit anomalies, and disruptions to bidding procedures and banking formalities.

Timelines for Approval:

Usually it will take around 20-30 days after filing of application with all relevant documentation. Any mistakes in the documents will leads to late approvals by the authorities.

Based on summaries drawn from practical operational practices, the approval timeline for administrative approval is affected by four core conditions: the accuracy of application materials, verification requirements, full payment of required fees, and application correction requirements. Compliant applications must submit all five required types of materials, including the WBPCB consent letter, and are processed far more quickly than applications with missing or mismatched information.
