Penalties for Non-Compliance of Factory License Rules

Starting a factory in Bihar without a license can result in severe punishments. According to Section 92 of the Factories Act, the occupier and manager of the factory may be held guilty for violating the Act, the Rules, or any written Orders. They may be punished with imprisonment for a term which may extend to two years, and a fine which may extend to ₹1,00,000 or with both. Where the contravention continues after conviction, an additional fine of ₹1,000 for each day during which the contravention continues may be levied.

Keeping the license up to date is also the factory owner’s responsibility. According to the Bihar Factories Rules, the renewal fee is equal to that of the original licensing fee. If the fee is not paid by January 15 of the following year, the renewal fee will be 150% of the fee. After March 31 of that year, the renewal will be 200% of the fee.
