Factory License in Maharashtra

Are you setting up a manufacturing business in Maharashtra?

Are you setting up a manufacturing business in Maharashtra? Getting a factory license in Maharashtra should be your first step. It is provided under the Factories Act, 1948 and the Maharashtra Factories Rules, 1963. It is a legal requirement to run a factory in the state.

A factory license in Maharashtra is not just a compliance document. It is a legal protection to ensure that your factory is safe and meets the health and safety needs of your employees. A factory operating without a license is subject to legal consequences and severe penalties. For these reasons, you must apply for a license before you begin any factory operations.

You can relax while you focus on your factory operations, as we are the experts in the factory licensing compliance space. We offer a host of factory licensing services in Maharashtra including easy online applications and timely license renewals.

The compliance steps we help you with today will allow your business to operate legally and be positioned to capture the market.

Who Needs to be Compulsorily Registered?

In Maharashtra, getting a factory license is mandatory if your premises qualify as a "factory" under the Factories Act, 1948.

A factory license isn't just a regulatory requirement—it's your business's foundation for credible, sustainable operations in India's financial capital. You'll need this license when your operation:

Key Registration Criteria

  • 10 or more workers: Employs 10 or more workers with power or machinery.
  • 20 or more workers: Employs 20 or more workers without power.

Common Industrial Categories

Examples of businesses that commonly require a Factory License in Maharashtra:

  • Pharmaceutical and chemical manufacturing
  • Textile and apparel manufacturing units
  • Food and beverage processing plants
  • Electronics and electrical equipment manufacturing
  • Metal fabrication and welding workshops
  • Plastic and polymer processing units
  • Packaging and printing units
  • Cosmetics and personal care manufacturing
  • Auto components and engineering workshops
  • Export-oriented manufacturing units

If you are the occupier of a factory—whether the owner, a partner, a director, or an officer—that factory license is your responsibility, regardless of whether you are the owner or a lessee of the premises.

Maharashtra has countless successful manufacturing units, including factories for pharmaceuticals, chemicals and textiles, food processing, waste recycling, metal fabrication, and automobile components. These manufacturing units know that when they take the time to get licensed, they are showing their commitment to building a compliant and credible business that can grow and succeed for the long-term. Don’t keep your business operating on an informal basis. Get licensed and prove your worth to the market.

The factory license has to be applied for by the occupier of the factory—most often the owner, partner, director, or another representative who has been authorized to manage the factory, regardless of whether the premises are owned or leased.

Penalties for Non-Compliance of Factory License Rules:

If you run a factory in Maharashtra without an appropriate Factory License, you can be prosecuted under the Factories Act. You can be punished with a ₹2,50,000 fine and/or a 3-year prison term, depending on the type and seriousness of the violation. Additionally, your factory can be sealed, and your factory operations can be suspended.

Factory owners are required to renew their licenses on time. If you apply for a license renewal after the expiration date, or within 30 days prior to the expiration date, you will be charged a 25% penalty on the annual license fee in addition to the standard annual license fee.

The online system will calculate any penalties or late fees, and you will pay the total amount due in the online payment system.

In Maharashtra, when a complete application for a factory license is filed through the Maharashtra Labor Department's online portal, you can expect the approval of your factory license within a period of 20 to 30 days.
